Sean “Diddy” Combs’ appeal for either an acquittal or a retrial was turned down on Tuesday, September 30, just days ahead of his upcoming sentencing.
In a ruling acquired by People and Deadline, Judge Arun Subramanian stated that the “government proved its case multiple times” in the federal proceedings against the celebrity. The judge mentioned that this alone could be sufficient to reject Combs’s appeal.
Subramanian’s ruling follows a hearing held on Thursday, September 25, in New York to review the rapper’s most recent motion.
In July, Diddy’s legal team submitted a motion requesting that the shamed music mogul, aged 55, either be acquitted or given the opportunity for a new trial. Earlier that month, the Grammy-winning artist was convicted on two counts relating to transportation for the purpose of engaging in prostitution, although he was acquitted of racketeering conspiracy and sex trafficking charges. Diddy pleaded not guilty to all accusations after his arrest in September 2024.
The verdict delivered on July 2 succeeded a widely publicized trial that spanned nearly two months. Diddy’s former girlfriend Cassie, with whom he had an on-and-off relationship from 2007 to 2018, testified against him, discussing alleged incidents of physical and sexual abuse during their time together. (Diddy has refuted all of her claims.)
In November 2023, Cassie, 39, initiated a lawsuit against Diddy, alleging abuse. He denied her accusations at that time, and the pair reached an out-of-court settlement just a day later. Numerous accusations were addressed in Diddy’s federal trial, with Cassie revealing in May that she accepted a settlement of $20 million for the initial case.
Since his arrest the previous year, Diddy has made multiple requests for bail, all of which have been declined by Subramanian. The most recent refusal occurred in August after Diddy’s lawyers contended that “exceptional circumstances” necessitated his release. However, Subramanian ruled that the defense did not establish any such circumstances and decided that Diddy would remain in custody at the Metropolitan Detention Center in Brooklyn, where he has been since his arrest.
Following the announcement of the verdict, when Diddy’s legal team sought his release, Cassie’s attorney urged the judge to reject his bail application.
“Ms. Ventura believes that Mr. Combs is likely to present a danger to the victims who testified in this matter, including herself, and to the community,” wrote attorney Douglas Wigdor.
The founder of Sean John faces a maximum sentence of 20 years in prison, with each transportation charge carrying a potential penalty of 10 years. Nevertheless, it’s anticipated that he will receive a considerably shorter term, with the year already spent in jail counting as time served.
Diddy is set to be sentenced on Friday, October 3. Prosecutors are advocating for an 11-year prison sentence, while Diddy’s legal representatives contend that he should face no more than 14 months in prison followed by supervised release.
