Erik Menéndez has returned to incarceration after a brief transfer to a hospital in San Diego last month for what his attorney referred to as a "serious medical condition," according to TMZ.
"My dad is back at the prison after being discharged from the hospital and is preparing for our forthcoming parole hearing," Erik’s stepdaughter, Talia Menéndez, posted on Instagram Stories over the weekend, as noted by the outlet.
Earlier in late July, Talia revealed that Erik, aged 54, had been taken to the hospital for treatment of painful kidney stones. She mentioned on Instagram Stories at that time, “Today Erik underwent his second surgery due to complications arising from multiple large stones in both kidneys.”
On July 24, Erik’s wife, Tammi Menéndez, communicated via X that he had experienced two surgical procedures and was anticipating a third.
“Today Erik had his second surgery. This procedure was a success. A third surgery is necessary and should take place soon,” Tammi commented. “Given Erik's prison status, there have been numerous complications and delays related to this surgery. He remains nauseous and in pain tonight, but is on the mend following the operation.”
She also expressed gratitude, stating, “We are thankful for everyone’s kind wishes and prayers. Surgical complications can arise, making this a particularly stressful time for us. Moreover, we appreciate the efforts of the CRT custody and medical personnel who provided their utmost support in this challenging situation.”
On July 22, Mark Geragos, the lawyer for Erik and his brother Lyle Menéndez, informed TMZ that Erik was facing a medical emergency but did not disclose specific details regarding Erik’s condition.
“I prefer not to divulge too much. Erik is facing a serious medical issue at this moment. I won't breach HIPAA or attorney-client confidentiality, but I believe if anyone deserves to be furloughed—especially right now, a month before the hearing—it is Erik,” Geragos appealed to California Governor Gavin Newsom for Erik's release from prison.
“It is a critical situation, and I feel he requires time outside to concentrate on the upcoming hearing,” he added. “I don’t want to delve into the specifics of the medical situation, but I believe that action is warranted.”
Erik and Lyle, who is 57, are currently incarcerated at the Richard J. Donovan Correctional Facility located in San Diego, California, following their convictions for the 1989 killings of their parents, José and Kitty Menéndez. They were found guilty of first-degree murder in 1996 and initially received life sentences without the possibility of parole.
However, their case gained renewed attention, partially due to the Netflix true-crime miniseries Monsters: The Lyle and Erik Menéndez Story, leading to their resentencing in May to 50 years to life, thus making them eligible for parole under California’s youth offender law.
Erik and Lyle are scheduled to appear before a parole board during a two-day hearing on August 21 and 22.
